Beat Bounce Terms of Service

1. Introduction

Welcome to Beat Bounce, a game developed by Creative Technology ("we", "us", "our"). By downloading, installing, or using the Beat Bounce mobile application (the "App"), you agree to comply with and be bound by these Terms of Service ("Terms"). These Terms govern your access to and use of the App.

2. License

Subject to your compliance with these Terms, Creative Technology grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the App for your personal, non-commercial use on a mobile device that you own or control. You may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

3. User Accounts

In order to access certain features of the App, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account.

4. User Content

The App may allow you to submit, post, or display content, including but not limited to text, images, and videos ("User Content"). You retain ownership of any intellectual property rights that you hold in the User Content. By submitting, posting, or displaying User Content, you grant us a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, modify, adapt, distribute, and display such User Content in connection with the App.

5. Prohibited Conduct

You agree not to engage in any of the following prohibited activities: (a) use the App for any illegal purpose or in violation of any local, state, national, or international law; (b) engage in any activity that disrupts, interferes with, or harms the App, servers, or networks connected to the App; (c) attempt to gain unauthorized access to the App, user accounts, or computer systems or networks connected to the App; (d) use any automated system, including without limitation "robots," "spiders," "offline readers," etc., to access the App in a manner that sends more request messages to our servers than a human can reasonably produce in the same period of time by using a conventional online web browser.

6. Termination

We may terminate or suspend your access to the App without prior notice or liability for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.

7. Disclaimer

The App is provided "as is" without warranty of any kind. We do not warrant that the App will be error-free or uninterrupted. We reserve the right to modify, suspend, or discontinue the App at any time without notice.

8. Limitation of Liability

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the state and federal courts located in the United States.
